الأمن القانوني للاستثمار في الجزائر

Résumé: من المفترض أن تهيئة الإطار القانوني لابد أن يكلل بتدفق الاستثمارات الأجنبية غير أن مؤشرات الاستثمار في الجزائر لم تعرف تحسنا، بل عرفت تدهورا كبيرا بسبب الصعوبات التي تواجه المستثمر الأجنبي، خاصة منذ صدور قانون المالية لسنة 2009، مما أدى إلى تراجع الأمن القانوني للاستثمار في الجزائر، ويرجع ذلك أساسا لانعدام الاستقرار القانوني من جهة وفرض قيود قانونية من جهة أخرى، لذا يتوجب البحث عن حلول قانونية من أجل الوقوف على متطلبات جذب الاستثمارات عن طريق توفير مناخ ملائم من ناحية تجسيد الدول المضيفة للأمن القانوني للاستثمار. It is assumed that the legal framework should be crowned with an influx of foreign investment, but the investment indicators in Algeria did not know improvement, but rather a significant deterioration due to the difficulties facing the foreign investor, especially since the issuance of the Finance Law for the year 2009, which led to the decline in the legal security of investment in Algeria This is mainly due to legal instability on the one hand and imposing legal restrictions on the other hand, so it is necessary to search for legal solutions in order to determine the requirements for attracting investments by providing an appropriate climate in terms of embodying the countries hosting legal security for investment.
