التكريس الدستوري للأمن القانوني في الجزائر: مساهم فعال في ضمان عقود الاستثمار الدولية

Résumé: إن نجاح أية دولة في استقطاب الاستثمارات الأجنبية مرهون بمدى تمتع منظومتها التشريعية بمقومات الأمن القانوني ومدى تحقق متطلباته، حيث يعتبر هذا المبدأ أحد أهم العوامل التي يبحث عنها المستثمرين الأجانب في الدولة التي يرغبون في إقامة مشاريعهم الاستثمارية فيها، لذلك تحرص مختلف الدول على تكريسه في تشريعاتها وتحقيق التطبيق الفعلي له، على غرار المشرع الجزائري الذي تبنى هذا المبدأ بموجب دستور سنة 2020. يؤدي إعمال مقومات الأمن القانوني في مجال عقود الاستثمار الدولية إلى تأمين حقوق المستثمرين الأجانب على مشاريعهم الاستثمارية، ويظهر ذلك من خلال إمكانية تضمين هذه العقود لبنود وشروط تلتزم بها الأطراف المتعاقدة، حيث يعتبر العقد المبرم بين المستثمر الأجنبي والدولة الجزائرية بمثابة قانون يحكمهم زيادة على قوانين الدولة وما تتضمنه من مبادئ ومزايا وضمانات مقررة لكافة المستثمرين. A state’s success in attracting foreign investment depends on the legal security of its legislative system. This principle is one of the most important factors that foreign investors are looking for in the state in which they wish to set up their investment projects. Therefore, the various states are keen to enshrine in their legislations similar to the Algerian legislation that adopted this principle under the constitution of 2020. The implementation of legal security in the field of international investment contracts ensures foreign investor’s rights over their investment, as demonstrated by the possibility of including in these contracts clauses to which the contracting parties are bound, where the contract between the foreign investor and the Algerian state is regarded as a law governing them in addition to the state’s laws and the principles advantages and guarantees they contain for all investors.
