Résumé: يعتبر المجلس النقدي و المصرفي جهاز تنظيمي وجد لوضع أسس لتأطير النظام المصرفي بهدف ضبط السياسة النقدية حيث أوكل له المشرع الجزائري من خلال القانون رقم 23/09 ، بوصفه سلطة نقدية تابعة لبنك الجزائر، مهمة تنظيم القطاع المصرفي حيث زوده بسلطة إصدار الأنظمة و القرارات الفردية، و بذلك يعتبر بمثابة سلطة تشريعية في المجال المصرفي مستقلة عن السلطة التنفيذية ، و--- يتمتع المجلس بإمتيازات السلطة العامة في المجال المصرفي على البنوك و المؤسسات المالية 9/من خلال منح التراخيص و سحب الاعتماد و تخضع هذه القرارات للطعن أمام القضاء الإداري و تختلف إجراءات الطعن حسب طبيعة القرار محل الطعن سواء كان فردي أو تنظيمي The Monetary and Banking Council is considered a regulatory body that was created to lay the foundations for framing the banking system with the aim of controlling monetary policy, as the Algerian legislator entrusted it, through Law No. 23/09, as a monetary authority affiliated with the Bank of Algeria, with the task of regulating the banking sector, as it provided it with the authority to issue individual regulations and decisions. Thus, it is considered a legislative authority in the banking field, independent of the executive authority, and the Council enjoys the privileges of public authority in the banking field over banks and financial institutions 9/ through granting licenses and withdrawing accreditation.
