جائحة كورونا تحد جديد على ضمان استمرارية سير المرافق العامة The Corona Pandemic Is A New Challenge To Ensuring The Continuity Of Public Facilities

Résumé: تعتبر المرافق العامة الركيزة الأساسية التي يقوم عليها القانون الإداري، وهي من أهم الوسائل التي تعتمد عليها الدولة في تقديم الخدمات دون توقف أو انقطاع، وذلك لإشباع حاجيات أفراد المجتمع، و السهر على ضمان حسن و استمرارية العمل الإداري، إلا أن الوضعية التي تعيشها الجزائر جراء تفشي وباء كورونا فرضت على السلطات العامة في الدولة اتخاذ إجراءات ذات طابع وقائي، والتي تحد من استمرارية سير المرافق العامة بانتظام و اضطراد و ذلك حماية للأمن الصحي العام، ومن هنا كان لا بد من إيجاد حل أو إجراء موازي يواكب هذه الظروف الاستثنائية، و يسمح بمواصلة عمل المرفق العام و استمراريته، ولا شك أن اسلوب الإدارة الالكترونية عن طريق تقديم خدماتها الرقمية، سيقلل من خطورة انتشار الوباء و يؤمن تفعيل مبدأ الاستمرارية. Public utilities are the main pillar of administrative law, and are one of the most important means on which the state relies to provide services without interruption, in order to satisfy the needs of members of society, and to ensure the good and continuity of administrative work, but the situation in Algeria as a result of the Corona epidemic has forced the public authorities of the state to take preventive measures, which limit the continuity of the regular functioning of public facilities and the need to protect health security. Generally, it was necessary to find a solution or parallel procedure that would keep pace with these exceptional circumstances, and allow the work of the public facility to continue and continue, and there is no doubt that the method of electronic management by providing its digital services, will reduce the risk of the spread of the epidemic and ensure the activation of the principle of continuity.
