مبدأ الاستقلال الملي للجماعات الإقليمية الفرنسية بين الغموض الدستوري ومتطلبات التكريس الفعلي له

Résumé: تهدف هذه الدراسة إلى تحليل وإبراز مبدأ الاستقلال المالي للجماعات الإقليمية الفرنسية حكما أن الدستور يمنح السلطات المحلية بعض الامتيازات المالية التي تسمح لها بممارسة اختصاصاتها الإدارية المالية والاقتصادية في حدود إقليمية معينة خاصة في ظل التطورات التي عرفتها اللامركزية فرنسا بالإضافة إلى تناول المعيقات التي تقف كعائق أمام التجسيد الفعلي لمبدأ الاستقلالية المالية للجماعات الإقليمية. أهم النتائج التي تم التوصل إليها هي رغم التطورات التي عرفها مبدأ اللامركزية إلا أنه لا يصل إلى درجة الإطلاق خاصة فيما يتعلق بالتمويل المحلي وهذا حفاظا على الدولة الجمهورية ككيان واحد، فمبدأ الاستقلال المالي الذي تبناه الدستور الفرنسي تعرف نوع من الغموض بحيث يتطلب الاستقلال المالي القدرة على تعديل قيود الميزانية في المكان والزمان بكل حرية بناء على مبدأ الإدارة الحرة. This study aims to analyze and highlight the principle of financial independence for French regional groups, given that the constitution grants local authorities some financial privileges that allow them to exercise their financial and economic administrative powers within certain regional borders, especially in light of the developments witnessed by decentralization in France, in addition to addressing the obstacles that stand as an obstacle to the actual embodiment of the principle of financial independence for territorial Communities. The most important results that have been reached are that, despite the developments witnessed by the principle of decentralization, it has not reached the absolute level, especially with regard to local financing, and this is in order to preserve the republican state as a single entity. The principle of financial independence adopted by the French Constitution is known for its kind of ambiguity, as financial independence requires the ability to Adjusting budget restrictions in place and time freely based on the principle of free management
