التصادم بين العولمة والسيادة

Résumé: تهدف هذه الدراسة إلى عرض وتحليل العلاقة بين العولمة والسيادة من خلال استعمال حقوق الإنسان كنموذج للتحليل. وهي تتألف من جزأين : في الجزء الأول تناولنا العولمة بين إمكانية التصادم والتعايش ومفهوم حقوق الإنسان في التصور الغربي وغير الغربي والاستخدامات المختلفة للمفهوم قانونيا واقتصاديا وسياسيا وثقافيا وختمنا هذا الجزء بملاحظات حول تعريف المفهوم واستخداماته مع عرض موجز لمفهوم السيادة وتطورها التاريخي ثم التساؤلات التي تطرحها. في الجزء الثاني تطرقنا إلى العولمة والسيادة وحقوق الإنسان والعلاقة بينهما وذلك على ضوء العناصر التالية: العولمة والسيادة علاقة التضاد تعريف حقوق الإنسان في المذاهب القانونية حقوق الإنسان في الفكر الغربي مقارنة بالفكر الإسلامي وتصور هذا الأخير للعولمة وحقوق الإنسان ثم العولمة والعالمية والخصوصية من خلال التمايز والتفاضل وليس التمييز. Abstract: this study aims at presenting and analyzing the relations between globalization and sovereignty through the uses of human rights as a model of analysis. The study contains two parts: part one deals with globalization between the possibility of coexistence and confrontation, human rights in the western and non-western perceptions and the different uses of the concept legally, economically, politically, and culturally. We concluded this part with some observations about the definition of the concept with brief presentation of sovereignty and its historical development then the juestios it raises. The second part dealt with globalization, sovereignty human rights and the relationship between them in the light of the following elements: globalization and sovereignty: conferential relations, the definitions ofhuman rights according to the legal doctrines, human rights in the western and non-western thoughts compared with the Islamic thought and the conception of Islam to globalization; human rights, universalismand specifity (relativism) through distinctions and not discrimination.
