الحماية القانونية للمقاول في عقد الأشغال العامة

Résumé: تبعا للدور الجوهري الذي يُؤديه المقاول في عقد الأشغال العامة من خلال اضطلاعه بمهمة إنجاز الأشغال بكافة المخاطر التي يمكن أن تنجم عنها، فقد كفل المشرع الجزائري في منظومته القانونية للمقاول قدرا من الحماية عن المخاطر التي يمكن أن تترتب عن إنجاز الأشغال. إن الحماية التي أقرها المشرع الجزائري للمقاول في عقد الأشغال العامة هي حماية ضيقة، مقارنة مع الحماية التي أقرها للإدارة المتعاقدة، ويتجلى ذلك في قلة وضئالة حقوق المقاول المتعاقد في مقابل السلطات الواسعة التي تتمتع بها الإدارة المتعاقدة، إذ تنحصر حقوق المقاول في الجانب المالي فقط.
