محدودية دور لجنة حدود الجرف القاري

Résumé: حاولت اتفاقية الأمم المتحدة لقانون البحار لعام 1982 أن توفق بين مختلف المطالب المتعارضة للدول بخصوص الجرف القاري، ما استتبع جملة من الثغرات القانونية من بينها الدور الممنوح للجنة حدود الجرف القاري الذي نجده محدود جدا، كونه يقتصر، فقط، في مساعدة و/أو مراقبة الدول الساحلية ذات الحواف القارية الممتدة التي تقرر تحديد حدود جرفها القاري خارج مسافة 200 ميلا بحريا من خطوط الأساس التي يقاس منها عرض البحر الإقليمي، بذلك تكون التسمية التي أطلقتها الاتفاقية على هذه اللجنة غير عاكسة لدورها الحقيقي في مجال تحديد حدود الجرف القاري. abstract:The 1982 United Nations Convention on the Law of the Sea has attempted to conciliate the various discordant claims of the states concerning the continental shelf, which resulted in a number of legal loopholes, such as the role assigned to the Commission on the Limits of the Continental Shelf, that we find very limited, Considering that that role comprises, only, assisting and/or controlling coastal states with extended continental margins, which decide to establish the limits of its continental shelf outside a distance of 200 nautical miles from the baselines from which the breadth of the territorial sea is measured. Consequently, the appellation given by the Convention to this Commission doesn’t reflect its true role in determining the limits of the continental shelf.
