ازدواجية" النظام القانوني للجرف القاري

Résumé: ملخص: أثرت اتفاقية الأمم المتحدة لقانون البحار لعام 1982 على النظام القانوني الموّحد للجرف القاري، وهذا ما يظهر جليا من خلال جزئها السادس الذي تبنى نظاما مزدوجا في تحديد الحد الخارجي للجرف القاري، وفي تكريس حقوق الدولة الساحلية على الثروات الطبيعية لهذا الجرف. تظهر ازدواجية نظام الجرف القاري في تحديد الحد الخارجي للجرف القاري من خلال نص المادة 76 الذي منح للدولة الساحلية سلطة انفرادية في تحديد الحد الخارجي لجرفها القاري عندما لا يزيد امتداد الحافة القارية عن 200 ميلا بحريا من خطوط الأساس التي يقاس منها عرض البحر الإقليمي وتقييده لهذه السلطة بتوصيات لجنة حدود الجرف القاري عندما يزيد امتداد الحافة القارية عن هذه المسافة، أما ازدواجية حقوق الدولة الساحلية على الموارد الطبيعية لجرفها القاري فتظهر من خلال الجمع بين نص المادة 76 ونص المادة 82، فالنص الأول منح للدولة الساحلية حقوقا سيادية خالصة في حدود 200 ميلا بحريا، أما النص الثاني فقد ألزمها بتقديم مدفوعات مالية أو مساهمات عينية لقاء استغلال الموارد غير الحية للجرف القاري وراء 200 ميلا بحريا. الكلمات الدالة: الجرف القاري، الدولة الساحلية، خطوط الأساس، الحافة القارية، البحر الإقليمي، حقوق سيادية خالصة، الثروات الطبيعية. Summary: The United Nations convention on the law of the sea has affect the unified legal regime of the continental shelf, and this because of its sixth part which characterized by a duplicity both in the determination of the outer limits of the continental shelf and in the consecration of coastal states rights on the natural resources of that continental. Indeed, the dual legal regime of the continental shelf as to the determination of its outer limits is explained by the fact that the article 76, while devoting unilateral authority to the coastal state in the determination of the outer limits of his continental shelf wherever the outer edge of the continental margin does not extend beyond 200 nautical miles from the baselines from which the breadth of the territorial sea is measured, it restricts this authority through the recommendations of the commission on the limits of the continental shelf wherever the outer edge extends beyond that distance. As for the duplicity of the coastal state rights on the natural resources of his continental shelf, it appears from the combination of the article 76 and 82. The first text grant exclusive sovereign rights to the coastal state in the limit of 200 nautical miles, while the second text compels the coastal state to make the payments or contributions in kind in respect of the exploitation of the non-living resources of the continental shelf beyond 200 nautical.
