رقابة النيابة علي أعمال ضابط الحالة المدنية Prosecutions Oversight Of The Civil Status Officers Work

Résumé: لقد خص قانون الحالة المدنية رقم 70/20 المعدل والمتمم سنة 2014 النيابة العامة بصلاحية ممارسة رقابة على أعمال ضباط الحالة المدنية تتجسد في مراقبة وتفتيش الوسائل والإمكانيات البشرية، وكذا مراقبة وتفتيش الوسائل والإمكانيات المادية. كما يتجلى رقابة النيابة العامة في العقود المغفلة، وإبطال العقود الخاطئة وتصحيحها أو تعديلها. كما لرئيس المحكمة وقاضي شؤون الأسرة دور كبير في مجال الحالة المدنية، وتتجلى هذه الرقابة في كون أن ضابط الحالة المدنية لابد عليه أن يرقم سجلات الحالة المدنية و يؤشر عليها في المحكمة، كما تمارس المحكمة رقابة على وثائق الحالة المدنية من تعديل وإلغاء وتصحيح، كما لقاضي شؤون سلطات في حالة وجود نزاع حول الزواج العرفي. Civil Status Law No. 70/20, amended and supplemented in 2014, assigns the Public Prosecution the power to exercise oversight over the work of civil status officers, embodied in the monitoring and inspection of human means and capabilities, as well as monitoring and inspection of means and material capabilities. The oversight of the Public Prosecution is also evident in the neglected contracts, invalidation and correction or modification of wrong contracts. The head of the court and the family affairs judge also have a major role in the field of civil status, and this control is manifested in the fact that the civil status officer must number the civil status records and mark them in the court, and the court exercises control over civil status documents such as amendment, cancellation and correction, as for a judge Affairs of the authorities in the event of a dispute over.
