دور المحكمة الدستورية في العملية الإنتخابية

Résumé: ملخص: إستحدث المؤسس الدستوري في التعديل الدستوري لسنة 2020 محكمة دستورية وهي مؤسسة دستورية مستقلة تتولى عملية الرقابة على دستورية القوانين وضمان احترام الدستور وسموه لتحل محل المجلس الدستوري. على خلاف المجلس الدستوري الذي كان له دور في العملية الانتخابية، فكذلك نجد للمحكمة الدستورية العديد من الصلاحيات التي مست مسار العملية الانتخابية من بدايتها الى غاية الإعلان عن النتائج النهائية، ويبرز الدور الفعال للمحكمة في تجسيد انتخابات نزيهة وذات شرعية من خلال بسط رقبتها على أية فعل من شأنه المساس بشفافية الاقتراع، وبالتالي يمكن القول أن المحكمة الدستورية تحتل مركز جد حساس في الحفاظ على أصوات الناخبين وتجسيد إختيارهم على أرض الواقع بعيدا عن التلاعبات التي من تجعل من الانتخابات عرضة للشك وعدم قبولها من المواطنين. Abstract: In the constitutional amendment of 2020, The constitutional founder created a constitutional court, Which is an independent constitutional institution in charge of monitoring the constitutionality of law and ensuring respect for the constitution and its highness, To replace .the constitutional Council Unlike the constitutional Council, Which had a role in the electoral process, We also find that the constitutional Court has many powers that touched the course of the electoral process from its inception to the announcement of the final results, Compromising the transparency of the voting, And therefore it can be said that the constitutional Court occupies a very sensitive position in preserving the votes of the electorate and embodying their choice on the ground, Away from the manipulations that make the elections subject to doubt and not being accepted by .the citizens
