الحماية القانونية للمستهلك والمهني المتعامل خارج نطاق تخصصه

Résumé: ملخص طرح موضوع حماية المستهلك وإفراده بنصوص أكثر ملاءمة إشكالا كبيرا في الآونة الأخيرة، وهذا ما تطرقت إليه منظمة المستهلكين الدولية باعتبار المستهلك الحلقة الأضعف في أي علاقة تعاقدية. وما زاد الإشكال حدة، هو التباين الواضح في تعريف المستهلك بين المفهومين الضيق والموسع، فالأول حصره في المتعاقد بهدف تلبية وإشباع حاجاته ورغباته الشخصية والعائلية، بينما يرى الثاني أنه قد يشمل المهني أو كل شخص يقوم بتصرف قانوني، سواء من أجل الاستخدام الشخصي أو المهني للسلع أو الخدمات، طالما كان ذلك التصرف خارج نطاق تخصصه. Abstract: Consumer protection and the issue of singling it out with more appropriate texts has been a major problem in recent times. This is what the International Consumer Organization has gone to, considering the consumer as the weakest link in contractual relations. However, the clear discrepancy in the definition of the consumer that moves between the narrow and enlarged concepts has made the problem even worse, the first has limited it to the contractor aiming to meet and satisfy his personal and family needs and desires, while the second definition considers that it may include professional or every person who performs a legal act, for the personal or professional use of goods or services, As long as it was outside the scope of his specialty.
