Résumé: بما أن المحكمة الجنائية الدولية أُنشئت بموجب معاهدة دولية فاختصاصها لا يمتد من حيث الأصل، إلا للجرائم المرتكبة على أقاليم الدول المنضمة إليها، غير أن نظام المحكمة خرج عن هذه القاعدة وسمح بامتداد اختصاص المحكمة إلى الدول الغير منضمة إليها، وذلك بعد موافقة هذه الأخيرة على ذلك، وعند ارتكاب جريمة على إقليم دولة غير عضو من طرف شخص يحمل جنسية دولة منضمة للمحكمة الجنائية الدولية، كما يمكن لمجلس الأمن الدولي متصرفا بموجب الفصل السابع من ميثاق الأمم المتحدة، أن يحيل للمحكمة أية حالة يبدوا فيها أن جريمة من الجرائم الداخلة في اختصاص المحكمة قد ارتُكِبت، حتى ولو تعلق الأمر بدولة غير طرف في المحكمة الجنائية الدولية.
