المحكمة الدّستوريّة في التّعديل الدّستوري 2020: الجديد و المستجدّ

Résumé: ظلّ المجلس الدّستوري هو الهيئة المكلّفة بالرّقابة على دستورية القوانين في الجزائر، إلى غاية التّعديل الدّستوري لسنة 2020، الذي اعتمد تسمية جديدة لهذه المؤسسة، و هي المحكمة الدستورية، و حدّد تشكيلتها و صلاحياتها، لذلك فالهدف الأساس لهذه الدراسة هو تحديد التغييرات التي عرفتها هذه المؤسسة مقارنة بالمجلس الدستوري من الناحية العضوية و الوظيفية، و كيف ساهم ذلك في تفعيل دور المحكمة الدستورية باعتبارها الجهة المكلفة بحماية مبدأ سموّ الدستور. Abstract: The Constitutional Council remained the body in charge of monitoring the constitutionality of laws in Algeria, until the constitutional amendment of 2020, which adopted a new name for this institution, which is the Constitutional Court, and defined its composition and powers. Therefore, the main objective of this study is to identify the changes that this institution has known. Compared to the Constitutional Council in terms of membership and functionality, and how this contributed to activating the role of the Constitutional Court as the body entrusted with protecting the principle of the supremacy of the Constitution.
