إخطار المحكمة الدستورية بين القيد وضمانة ممارسة اختصاصاتها

Résumé: استحدث المؤسس الدستوري مؤسسة المحكمة الدستورية كجهة رقابية لتحل محل الهيئة المسماة المجلس الدستوري ومنحها العديد من الصلاحيات، بعضها كانت ممنوحة للمجلس الدستوري وبعضها مستحدث، إلا أنه لا يمكن للمحكمة الدستورية ممارسة اختصاصاتها إلا من خلال آلية الإخطار، هذه الآلية ممنوحة للسلطات العامة في الدولة، كما أن الدستور الجزائري ميز بين الإخطار الوجوبي الذي ينفرد به رئيس الجمهورية والاخطار الجوازي الذي تمارسه السلطة التنفيذية والتشريعية والاخطار عن طريق الإحالة الذي تمارسه السلطة القضائية من خلال المحكمة العليا ومجلس الدولة. يشكل الاخطار الجوازي وآجاله القصيرة قيدا على ممارسة المحكمة الدستورية لاختصاصاتها المنصوص عليها في الدستور، إلا أنه بخصوص الإخطار الوجوبي وآلية الدفع بعدم الدستورية فإنهما يشكلان ضمانة لممارستها للاختصاص الرقابي وقيامها بالدور الاجتهادي في المادة الدستورية. The constitutional founder created the Constitutional Court as a supervisory body to replace the body called the Constitutional Council and granted it many powers, some of which were granted to the Constitutional Council and some of which were newly created. However, the Constitutional Court cannot exercise its powers except through the notification mechanism, which is granted to the public authorities in the state. The Algerian Constitution also distinguished between the mandatory notification exercised by the President of the Republic alone, the permissible notification exercised by the executive and legislative authorities, and the notification by referral exercised by the judiciary through the Supreme Court and the Council of State. The mandatory notification and its short deadlines constitute a restriction on the Constitutional Court’s exercise of its powers stipulated in the Constitution. However, with regard to the mandatory notification and the mechanism for pleading unconstitutionality, they constitute a guarantee for its exercise of supervisory powers and its performance of the interpretative role in the constitutional article.
