موقف المشرع الجزائري من التحرش الجنسي ضد المرأة The Position Of Algerian Legislator On Sexual Harassment Against Women

Résumé: ملخص إن مصطلح التحرش الجنسي له خصوصيته في المجتمعات الإسلامية وغيرها من المجتمعات الأخرى للعواقب النفسية المترتبة على هذه الظاهرة. والتحرش الجنسي هو عبارة عن ممارسة مجموعة من الأفعال والسلوكيات والكتابات أو التصريحات المباشرة أو غير مباشرة، عن طريق الانترنت والتي تساهم من خلال تكرارها، وطبيعتها المهينة والمقيتة في الأذى النفسي أو الجسدي للضحية، ولا يهم أن يكون هذا التحرش ناجمًا عن فرد أو أكثر. أو يكون له غرض أولا، ذلك أن نتيجته مدمرة . وقد تطرق المشرع الجزائري لجريمة التحرش الجنسي لأول مرة في قانون العقوبات الجديد طبقا للقانون رقم 04/ 15 المؤرخ في نوفمبر 2004 المعدل؛ حيث عدلت المادة 341 مكرر من (ق.ع .ج المعدل بقانون 16_02 والمتمم للأمر 66_156 والمتضمن قانون العقوبات) لتشديد العقوبة على المسئول المستغل لموظفيه لارتكاب الجريمة، علاوة على ذلك، فإن العقوبة قد تتضاعف إذا كان مرتكب الجرم قريب من المتحرش أو كان الضحية قاصر، أو امرأة حامل، أو من المرضى أو المعاقين . الكلمات المفتاحية :التحرش الجنسي ، إثبات التحرش، التشريع الجزائري ، المرأة . Abstract The term sexual harassment has its specificity in Muslim societies and other societies as to the psychological consequences of this phenomenon. It is the practice of a series of acts, behaviors, writings or statements direct and indirect on the Internet that contribute by its repetition, its degrading and abominable nature. The psychological or physical harm suffered by the victim, and regardless of whether such harassment is caused by one or more individuals. Or has a goal or not, because its result is devastating. According to the Algerian legislator, sexual harassment is a form of violence against women: Article 341 bis (amended by Law 16-02 and supplemented by Ordinance 66_156, which includes the Penal Code) has been amended to strengthen the sentence of a staff member who employs his staff to commit the crime.
