دور مبدأ المساواة في تدعيم حماية الحقوق الانتخابية (دراسة في ضوء اجتهادات المجلس الدستوري)

Résumé: يعدّ مبدأ المساواة من أهم الحقوق التي نصت عليها المواثيق والاعلانات الدولية الخاصة بحقوق الانسان، وكرّستها الوثائق الدستورية للدول، ويتعامل القضاء الدستوري المقارن مع مبدأ المساواة، باعتباره أساسا عاما وضابطا حاكما لمنظومة الحقوق والحريات ككل، فهو مبدأ له مكانة مزدوجة في النظام القانوني، باعتباره حقـا مـن الحقـوق الأساسية، وفي نفس الوقت يعد شرطا أساسيا لممارسة باقي الحقوق والحريات. على هذا الاساس، وانطلاقا من تكريس المؤسّس الدستوري في الجزائر لمبدأ المساواة، وظّف المجلس الدستوري هذا المبدأ وألزم به المشرّع، وذلك لتحقيق الحماية المثلى لمختلف الحقوق والحريات، ومنها بشكل خاص الحقوق الانتخابية. The principle of equality is regarded as one of the most important rights stipulated by the international human rights declarations and treaties and enshrined in the constitutional instruments of the States. The comparative constitutional justice considers the principle of equality as a general basis and a regulator of the system of rights and freedoms as a whole, since it is a dual status principle in the judiciary system being a fundamental right and at the same time a main requirement for exercising the rest of the rights and freedoms. On such a ground, and based on the consecration of the principle of equality by the Algerian constitutional founder, the Constitutional Council enshrined the foregoing principle and committed the legislature thereto, in order to ensure optimum protection of the various rights and freedoms, particularly electoral rights.
