دور الاجتهاد الدستوري الجزائري في تكريس مبدأ المساواة في الحقوق والحريات السياسية

Résumé: ملخص: تعالج هذه الورقة البحثية مبدأ المساواة في الحقوق والحريات السياسية، ومدى مساهمة الاجتهاد الدستوري في تكريسه، إذ يكتسي هذا الموضوع أهمية بالغة، تتجلى في قيمة مبدأ المساواة كمبدأ دستوري، وكذا أهمية الحقوق والحريات السياسية بالنسبة للمواطن، الذي يتطلع إلى المشاركة في تسيير الشؤون السياسية لوطنه دون تمييز، وقد كان للاجتهاد الدستوري دور في تطبيق هذا المبدأ في الحقوق والحريات السياسية، وذلك من خلال رقابة مطابقة القوانين المتعلقة بالانتخابات والأحزاب السياسية للدستور Abstract This current paper investigates the principle of equality in the political rights and freedomes, and the extent to which constitutional jurisprudence contributes to its consecration. This issue is of great importance, which is reflected in the value of the principle of equality as a constitutional principle, as well as the importance of political rights and freedoms for the citizens who are inclined to participate in the conduct of the political affairs of his country without discrimination. Hence, the constitutional jurisprudence played a significant role in applying this principle in political rights and fredooms by means of monitoring the conformity of laws related to elections and political parties to the constitution.
