مكافحة الفساد من خلال التصدي لجرائم الصفقات العمومية

Résumé: ملخص: يتحدث صاحب المقال في هذه الورقة البحثية عن جرائم الصفقات العمومية التي أصبحت أهم منفذ لنهب المال العام، وهو ما دفع بالمشرع إلى تشديد الرقابة على الصفقة وتجريم الأفعال التي تمس بحسن سيرها، وذلك إدراكا منه لخطورة هذه الجرائم وتداعياتها على مختلف المستويات والأصعدة، وقد تم النص على هذه الجرائم في القانون رقم 06-01 المتضمن الوقاية من الفساد ومكافحته والذي تضمن في نصوصه: جريمة لمحاباة، جريمة استغلال نفوذ أعوان الدولة للحصول على امتيازات غير مبررة، جريمة الرشوة، وجريمة أخذ فوائد بصفة غير قانونية، ولم يكتف المشرع بتجريم هذه الأفعال والمعاقبة عليها، بل قرر لها أحكاما خاصة كتغليظ العقوبات، كما أدخل عليها مفاهيم جديدة كمفهوم الموظف العمومي، الذي توسع فيه المشرع بصورة غير مسبوقة. ABSTRACT: In this article, the author talks about the crimes of public procurements, which have become the most important outlet for looting public purse, which prompted the legislator to tighten control over the public procurements and criminalize acts that affect its proper conduct, recognizing the seriousness of these crimes and their repercussions at different levels. These crimes were stipulated in Law N°: 06-01, which includes the prevention and the fight against corruption, which included in its texts: crime of nepotism, crime of exploiting the influence of state agents to obtain unjustified privileges, crime of bribery, and crime of taking benefits illegally, and the legislator did not stop at the criminalization and punishment them, rather he decided to adopt special provisions for them such as harsher penalties, and he also introduced new concepts to them, such as the concept of the public official, which the legislator expanded in an unprecedented way.
