أثر الفقه المقارن في مؤلفات المالكية

Résumé: يعالج المقال موضوع المقارنة الفقهية في مؤلفات المالكية، وهو موضوع مهم يدفع تهمة تعصب المالكية لرأي إمامهم دون دليل، ويبرز بالدليل موضع المقارنة ومنهجها، حيث باستقراء هذه الكتب والنظر فيها يبدو تميز المالكية وتفوقهم في فقه الخلاف منذ العهد الأول حيث انفتحوا على رأي المخالف ووقفوا على دليله ولم ينقل عنهم أبدا تعصبهم دون دليل، وقد بدت مناهج ثلاث في مقارناتهم وهي المنهج الجدلي الحجاجي، والمنهج الأثري، والمنهج التأصيلي، وبهذا المنهج تطور الفقه المالكي وتوسعت أصوله الاجتهادية. The article deals with the comparative jurisprudence in compilations of Maalikis, which is an important issue that it pushing back the intolerance charge Maliki to the opinion of Imam without proof. By extrapolating these books, it seems distinguish and superiority of Maalikis in the jurisprudence of the dispute since the first covenant witch they opened up to the dissenting opinion. Three methods have appeared in the field of comparative jurisprudence: the Hajaji dialectical approach, Athari and Taassili approach.With this approach Fiqh al-Maliki has evolved and its jurisprudential assets have expanded.
