التعاون الدولي في مجال استرداد الموجودات المتاتية من جرائم الفساد الاداري

Résumé: تهدف هذه الدراسة إلى تقديم رؤية وصفية تحليلية حول مجالات التعاون بين الدول لمكافحة الفساد وذلك من خلال تسليط الضوء على تدابير وإجراءات استرداد الموجودات والعائدات المتأتية من جرائم الفساد، إذ يعد استرداد الموجودات مبدأ أساسيا من مبادئ دعم تعزيز الجهود الدولية في مجال منع ومكافحة الفساد، كما أنه مبدأ هام في اتفاقية الأمم المتحدة لمكافحة الفساد حسبما تقتضيه المادة 51 منها، ويعد غرضا من أغراضها كما ذهبت إلى ذلك المادة الأولى من الاتفاقية المذكورة، ، لذا كان من الضروري إتخاذ تدابير كافية في إطار التعاون الدولي لاسترداد الموجودات، وتتمثل على وجه الخصوص في استـرداد الممتلكات عن طريق التعاون الدولي في مجال المصادرة ، وقبل ذلك وبغية الكشف عن العمليات المالية المرتبطة بالفساد يتعين على البنوك والمؤسسات المصرفية اتخاذ ما يلزمها من ترتيبات لمنع تحويل عائدات الفساد وكشفها. This study aims to provide Analytical and descriptive view on areas of cooperation between countries to fight corruption the measures and procedures for the recovery of assets and the proceeds derived from corruption offenses, as the assets' recovery is one of the fundamental principles supporting the strengthening of international efforts in the field of preventing and combating corruption, as well as an important principle in the United Nations Convention against Corruption, as required by Article 51, and it's considered as one of its purposes as mentioned in article one of the Convention, so it was necessary to take adequate measures in the framework of international cooperation for the recovery of assets, and is in particular in the recovery of properties through international cooperation in confiscation, and before that, in order to detect the financial operations associated with corruption, banks and financial institutions should take the necessary arrangements to prevent and expose the diversion of corruption proceeds.
