المحافظة على البيئة في أوقات الحروب المسلحة على ضوء ما قرره القانون الدولي الإنساني Preserving The Environment In Times Of Armed Wars In The Light Of International Humanitarian Law

Résumé: تعد فكرة المحافظة على البيئة في أوقات الحروب والنزاعات المسلحة من بين القضايا التي اولاها القانون الدولي الإنساني أهمية بالغة نتيجة ما وصلت اليه البيئة من تدمير وضرر، ما يعتبر انتهاكا صريحا لحقوق الانسان الأساسية الا وهي حق الانسان في العيش ضمن بيئة نظيفة وسليمة رغم ان العديد من المواثيق والبرتوكولات والاتفاقيات الدولية كرست هذا الحق عن طريق اليات تساهم في تعزيز مفهوم المحافظة على البيئة السليمة والنظيفة. غير ان الملاحظ ان هذه الاليات لاتزال تحتاج الى المزيد من الإصلاح والتقويم والالتزام المعنوي أكثر من الالتزام القانوني للمحافظة على البيئة في كل الأوقات والظروف وليس في وقت الحرب فقط The idea of preserving the environment in times of wars and armed conflicts is among the issues that international humanitarian law attaches great importance to as a result of the destruction and damage that the environment has reached, which is considered an explicit violation of basic human rights, which is the human right to live within a clean and sound environment, although many International charters, protocols and agreements enshrined this right through mechanisms that contribute to promoting the concept of preserving a healthy and clean environment. However, it is noted that these mechanisms still need more reform, correction, and moral commitment more than the legal commitment to preserve the environment at all times and circumstances, not only in wartime.
