الحماية القانونية للبيئة في ظل الاتفاقيات الدوليةlegal Protection Of The Environment Under International Agreements

Résumé: هيأ الله تعالى الكرة الأرضية لحياة الإنسان وأودع فيها جميع ما يحتاجه، وجعلها مقرا مناسبا لمعيشته صالحا لبقائه واستمراره وأمره بعمارتها وجعله خليفة فيها، وسخر له ما على ظهرها وما في باطنها والهواء المحيط بها، بل امتد التسخير ليصل إلى الشمس والقمر وغيرهما مما في السماوات التي لا يعلم مداها إلا الله، ولكن الإنسان وفي غمرة البحث عن المزيد من الترف والرقي، اندفع ليفسد ويدمر فيما خلقه تعالى من حوله بطرق جائرة غير رشيدة. ولعل تلك النتائج السلبية المترتبة عن الحروب والنزاعات المسلحة، التي خلفت آثارا وخيمة على البيئة، ولاعتبارات تتعلق بحمايتها، كان من ثمارها أن بدأت النظم القانونية العالمية والمحلية بجعل موضوع المحافظة على البيئة وضرورة حمايتها ضمن أولويات اهتمامها، ومن هنا تنطلق هذه الدراسة ببيان ماهية القواعد والأحكام المعنية بحماية البيئة زمن النزاعات المسلحة، بهدف التعرف والوقوف على ما توفره هذه الأحكام وتلك القواعد من حماية البيئة في كافة صورها ومظاهرها في أوقات السلم والحرب. God Almighty prepared the globe for human life and deposited in it all that he needs, and made it a suitable place for his living, suitable for his survival and continuity, and commanded its construction and made him a successor in it, and subjected to him what is on its back and what is in its interior and the air surrounding it. Only God knows its extent, but man, in the midst of searching for more luxury and sophistication, rushed to corrupt and destroy what God Almighty created around him in unjust and irrational ways. Perhaps those negative results resulting from wars and armed conflicts, which left dire effects on the environment, and for considerations related to its protection, were among the fruits that global and local legal systems began to make the issue of preserving the environment and the need to protect it a priority of their concern, and from here this study begins by stating what the rules and provisions are. Concerned with the protection of the environment in times of armed conflict, with the aim of identifying and finding out what these provisions and those rules provide for protecting the environment in all its forms and manifestations in times of peace and war.
