اختصاص المحكمة الدستورية بتفسير الدستور في ظل التعديل الدستوري 2020

Résumé: الملخص: استحدث المؤسس الدستوري الجزائري المحكمة الدستورية بموجب التعديل الدستوري 2020 وميزها باختصاص تفسير الدستور على خلاف المجلس الدستوري سابقا لكن وفق شروط وضوابط تضمن استقلاليتها ،حيث يمكن للمحكمة الدستورية وبناءً على طلب من أحد الجهات المحددة في الدستور إزالة أي لبس أو غموض قد يعتري نص في الدستور ورغم تأكيد المؤسس الدستوري في المادة 192 على إلزامية القرارات الصادرة عنها بشأن الرقابة على دستورية القوانين و النظر في الطعون المتعلقة بالانتخابات إلا أنه لم يشر إلى مدى إلزامية الآراء الصادرة عند ممارسة اختصاص تفسير الدستور. Abstract: The Algerian constitutional founder created the constitutional court under the constitutional amendment 2020,and distinguished with the competence to interpret constitution , unlike the pervious constitutional and council, , but according to condition and controls that guarantee its independence .the constitutional establishment’s emphasis inArtcle192on the mandatory decisions issued by it regarding the oversight of the constitutionality of laws and the consideration of appeals related to election, but it did not indicate the extent mandatory opinions issued when exercising the jurisdiction to interpret the constitution
