عقد البيع على التصاميم وخصوصيته في التشريع الجزائري

Résumé: يعتبرعقدالبيع بناءعلى التصاميم صيغة مستحدثة للبيوع العقارية في الجزائرمن حيث التنظيم القانوني والممارسات الميدانية ، وقد اثار التطبيق العملي للنصوص المتعلقة به اشكالات عملية عديدة اثرت على حقوق المشترين للشقق السكنية ، تتمثل في مدى كفاية هذا العقد الرسمي المسجل والمشهر لوحده لانتقال ملكية الشقة دفعة واحدة للمشتري ، ام يجب ان يستكمل بعد إنجاز البناية بمحضر تسليم الشقة وضرورة شهره ، ومتى يبدا سريان الشرط المانع من التصرف في هذه الشقق ، خاصة اذا علمنا ان محضر تسليم الشقة يذكر فيه تاريخ تسليم شهادة المطابقة التي يتحدد بموجبها تاريخ سريان الشرط المانع من التصرف مما يضر بحقوق المشتري الذي يريد ان يتصرف شقته مستقبلا الكلمات المفتاحية : عقد البيع على التصاميم ، انتقال الملكية ، محضر التسليم لشقة ، شهادة المطابقة .
