مبدأ المعاملة العادلة والمنصفة للاستثمارات الأجنبية في ظل القانون رقم 09-16 المتعلق بترقية الاستثمار
Résumé: يطالب المستثمر الأجنبي بتكريس الضمانات والحماية القانونية للقدوم والاستثمار في الدولة المستقبلة له، نظرا لانعدام التوازن بينه وبين الدولة المضيفة للاستثمار، ويتوقف اتخاذه لقرار الاستثمار بتكريس هاته الحماية الأمر الذي دفع بالدولة الجزائرية للاستجابة بتكريس مبدأ المعاملة العادلة والمنصفة للاستثمارات الأجنبية سواء في إطار قوانينها الداخلية أو في ظل الاتفاقيات الدولية الثنائية أو المتعددة الأطراف المصادق عليها .نظرا لدوره الفعال في تحسين مناخ الأعمال وجلب المراسيم الأجنبية، والدفع بعجلة التنمية الاقتصادية Abstract: The foreign investor wishes to devote guarantees and legal protection to him so that he comes to invest in the host country, due to the lack of balance between him and the host country of the investment, and his decision investing depends on this protection. Thus, the Algerian State has responded by granting fair and equitable treatment to foreign investments, whether within the framework of its national laws or within the framework of ratified bilateral or multilateral international agreements, given its effective role in improving the business climate and attract foreign capital and accelerate economic development
