قاعدة –تصرف الإمام على الرعية منوط بالمصلحة-وأثرها في فتاوى علماء المالكية -توظيف الضرائب نموذجاً-

Résumé: المقصود من البحث في هذه القاعدة بيان حدود الإدارة العامة وتصرفات ولاة أمر المسلمين على الرعية،واشتراط أن يكون نظرهم عند التصرف راجعا إلى المصلحة المتحققة دون إلحاق الضرر بهم،وهذا من منطلق المعنى المقصود من هذا المنصب الجليل،وكان من آثار تطبيق هذه القاعدة عند علماء المالكية تأصيلهم الكلام عن مسألة توظيف الضرائب أو الخراج على الرعية،مع مراعاة شروط معينة يجب توافرها،وتخريجها على قاعدة عظيمة من قواعد الشريعة وهي جلب المصالح ودرء المفاسد والقبائح. ABSTRUCT The intention from looking into this rule statement is to distinguish the field of the public administration and the Muslim's governor on their nation, their act should take on consideration the benefit of their nation and making sure to not inflict damages ,for which they merit this precious post. The maalikis schoolers consider the implementation of this rule as the rooting application of taxes regulation ,considering some conditions. This application is under one major Islamic rule "brining benefits and warding off evil".
