Résumé: الملخص: لا يخفى على أحد أهمية البيئة ونفعها للإنسان حيث إن الله تعالى جعل فيها مقومات الحياة وعوامل البقاء؛ ليتسنى له أداء مهمته الاستخلافية على ظهر هذه البسيطة تحقيقا للعبودية لله عز وجل. فجاءت الشريعة منظمة علاقة الإنسان بالكون من حوله - فضلا عن تنظيمها علاقته بربه وبمجتمعه- وفق الأحكام الشرعية التكليفية المعروفة، ولا بد أن يتوافر الوعي البيئيّ لدى الأفراد بحمايتها من كل ما يضرّ بها ويفسدها، كما ينبغي أن يتوافر كذلك لدى المسؤولين في الدولة؛ إذ إن رسوخ الوعي البيئي في نفس ولي الأمر يعتبر أمرا في غاية الأهمية في انضباط الأفراد، ولقد قرر أئمة الفقه القاعدة الفقهية (تصرف الإمام على الرعية منوط بالمصلحة) ولهذه القاعدة تطبيقات عديدة في مجالات الحياة الاجتماعية والسياسية والاقتصادية وفي التعامل مع البيئة الطبيعية لحماية مواردها من التلوث؛ بوضع الاشتراطات والضمانات الكفيلة بذلك؛ ما كان عاما أو خاصا، زراعيا أو صناعيا. ومن هنا جاءت هذه الدراسة لتكشف عن بيان هذه القاعدة، وذكر بعض التطبيقات المتعلقة بالبيئة التي تنطوي تحتها حتى يكتمل المقصد من ورائها. وعلى ضوء ذلك انتظمت الدراسة في مطلبين؛ المطلب الأول يتعلق بتحديد معنى القاعدة وبيان نصوصها وأدلتها، وأما المطلب الثاني فيتعلق بالجانب التطبيقي للقاعدة وذلك في المجال البيئي، وخُتم البحث بأهم النتائج المتوصل إليها. Summary: Everybody is aware of the importance of the environment and its benefit to the human being. God made the elements of life and survival factors; so that man can perform his task of intelligence on the earth to achieve worship to God Almighty. The Sharia comes as an organization of the relationship between man and the universe around him - as well as the organization of his relationship with his Lord and his community - in accordance with the provisions of the Shari'a known mandate, and there must be environmental awareness for individuals to protect it from everything that harms and corrupts, and should also be available to officials in the State; The establishment of environmental awareness in the same time is very important in the discipline of individuals, and has decided the Imams of jurisprudence rule (the imam's behavior on the public is dominated by the interest). This rule has many applications in the areas of life: social, political and economic and in dealing with the natural environment in order to protect its resources from pollution by establishing the requirements and guarantees to do so, whether public or private, agricultural or industrial. Hence, this study revealed the statement of this rule, and mentioned some applications related to the environment under which it is intended to complete its purpose. The second requirement relates to the application of the rule in the environmental field, and concludes the research with the most important results achieved.
