النظام القانوني لوكالات السياحة والأسفار في التشريع الجزائري (the Legal Regime Of Tourism And Travels Agencies Under Algerian Law)

Résumé: تلعب وكالات السياحة والأسفار دورا مهما في ترقية السياحة فهي العنصر الأساسي الذي يربط بين السائح من جهة وبقية المتعاملين في هذا المجال من جهة أخرى. لقد نظم المشرع الجزائري نشاط وكالات السياحة والأسفار بموجب القانون رقم 99-06 الذي ألغى القانون القديم رقم 90-05، كما دعمه بمرسوم تنفيذي رقم 17-161 والذي ألغى بدوره المرسوم رقم 2000-48، وهذا ما يدل على إرادة الدولة في إيجاد تنظيم محكم وفعال لهذا النشاط لضمان أمن السائح وراحته وكذا تعزيز الاقتصاد الوطني. لقد حاول القانون الجديد المنظم لنشاط وكالات السياحة والأسفار ومعه نصه التنظيمي الإحاطة بكل جوانب هذه المهنة، إلا أنه ما زالت تكتنفه بعض النقائص، فعقد السياحة والأسفار عقد مركب تمتزج فيه عدة عقود ما يستدعي تحديد طبيعته القانونية لمعرفة القانون الواجب التطبيق في كل الحالات. Abstract : Tourism and travel agencies play an important role in promoting tourism, it is the fundamental element that binds the tourist on the one hand with other operators in the field on the other hand. The activity of tourism and travel agencies is governed by act 99-06 which repealed the former act 99-05, and regulated by executive decree 17-161, which in turn repealed executive decree 2000-48, which demonstrates the state’s commitment to implimenting a rigourous and effective system to guarantee the safety and well-being of tourists and thus strengthen the national economy. The new law and its executive decree were an attempt by the legislator to identify the activity of tourism and travel agencies on all sides, however, there are still some gaps to be filled, indeed, the tourism and travel contract is a complex contract, it is a combination of several special contracts, which requires the determination of its legal nature to deduce the law applicable to all cases of figures.
