توجهات السياسة العقابية في ردع جريمة المضاربة غير المشروعة Punitive Policy Directions In Deterring The Crime Of Illicit Speculation

Résumé: تدخل المضاربة غير المشروعة في نطاق الجرائم الاقتصادية، بالنظر للتلاعبات في إحداث الندرة في السوق، خفض ورفع الأسعار...، مما يؤدي الى حدوث تقلبات في السوق والمساس بالاقتصاد عموما، وهذا بلوغا لتحقيق الأرباح الشخصية. وسعيا منه لردع جريمة المضاربة غير المشروعة، تدخل المشرع الجزائري لإلغاء النصوص المتعلقة بهذه الجريمة، والتي كانت واردة في قانون العقوبات، واستحداث أخرى أشد صرامة بموجب القانون رقم 21-15 المتعلق بمكافحة المضاربة غير المشروعة، ومرد ذلك هو قصور النصوص العقابية بالتزايد الرهيب لحصيلة المضاربات غير المشروعة، لا سيما في المواد واسعة الاستهلاك. Abstract: Illicit speculation falls within the scope of economic crimes, given the manipulation of market scarcity, the reduction and increase of prices..., which is detrimental to market volatility and to the economy in general, and this is a profit. In an effort to deter the crime of illicit speculation, Algerian legislation had made an intervention to repeal the provisions relating to that crime contained in the Penal Code and to introduce another under Act No. 21-15 on combating illicit speculation, the result of which was the inadequacy of punitive provisions by the terrible increase in the incidence of illicit speculation, particularly in large-scale articles. key words: Illicit speculation, scarcity, economic crime, punitive policy, criminal sanctions
