اللاجئ البيئي: تحدي للقانون الدولي Environmental Refugee: A Challenge To International Law

Résumé: الملخص: أمام التدهور البيئي في ظل التغيرات المناخية عبر العالم، ظهرت فئة جديدة من النازحين عن مواطنهم تتزايد اعددهم كلما ازداد الكوارث الطبيعية او بفعل الإنسان والمؤثرة على البيئة على جميع الأصعدة، مما يتطلب و على وجه السرعة دراسة وتنظيم تلك الظاهرة وتوفير الحماية الدولية لهؤلاء بصفتهم لاجئين بيئيين أساسا أمام غياب اية وثيقة دولية تغطي حمايتهم، ولو فكرنا في اتفاقية جنيف لعام 1951 م والتي يعتبرها ضعف شديد حتى في حماية اللاجئين عموما، فعليه يكون الهدف من دراستنا هذه هو تسليط الضوء على مفهوم اللاجئ البيئي كمسألة خلافية تتعلق بتسمية هؤلاء النازحين لأسباب التغيرات المناخية من جهة، ولكيفية تعامل ومعالجة القانون الدولي لحمايتهم حاليا وتقبل مفهوم " اللاجئ البيئي" دوليا من جهة أخرى. Abstract: In the face of environmental degradation in the context of climate change across the world, a new category of displaced persons has emerged, which is growing in number as natural or human-induced disasters, affecting the environment at all levels, increase. This phenomenon needs to be urgently examined and regulated and to provide international protection to them as environmental refugees in the absence of any international document covering their protection. And if we think of the Geneva Convention of 1951 M, which he considers to be very weak even in protecting refugees in general, The aim of this study should be to highlight the concept of an environmental refugee as a controversial issue regarding the designation of such displaced persons for reasons of climate change on the one hand. and how to deal with and address international law for their protection now and accept the concept of "environmental refugee" internationally.
