إشكالية الحق في الأبوة على المصنفات المشتقة: أعمال الترجمة أنموذجا

Résumé: ينظم الأمر رقم 03-05 المتعلق بحقوق المؤلف والحقوق المجاورة مسألة الحماية القانونية لمختلف المصنفات الأدبية والفنية الأصلية منها والمشتقة، ومن قبيل هذه المصنفات المشتقة التي يحميها هذا النص القانوني نجد ما يسمى بأعمال الترجمة، والتي يحظى صاحبها بجملة من الحقوق المادية والمعنوية، حيث تكفل الأولى الحق الإستئثاري للمؤلف في إستغلال إبداعه الفكري وتحقيق الربح جراء هذا الإستغلال، بينما تؤدي الحقوق المعنوية مهمة حماية الشخصية الفكرية للمؤلف، ومن أهم وأبرز هذه الحقوق المعنوية: حق المؤلف في الأبوة على مصنفه وهو الحق الذي يمكّن صاحب أعمال الترجمة من نسبة مصنفه إليه دون سواه مع مراعاة حقوق مؤلف المصنف الأصلي الذي يكون محلا لعملية الترجمة سواء المعنوية منها أو المادية. Ordinance No. 03-05 on authors' rights and neighboring rights regulates the legal protection of various original and derived literary and artistic works and, like these derivative works protected by this legal text, we find the so-called translation work, the first guarantees the author's legitimate right to exploit his intellectual creativity and profit as a result of such exploitation, Moral rights serve the task of protecting the author's intellectual personality. The most important and prominent of these moral rights are: The author's right to parenthood is classified as a right that enables the author of the translation work to be classified exclusively to him, considering the rights of the author of the original classification, which is the subject of both moral and material translation.
