دور البصمة الوراثية في إثبات جريمة الاغتصاب وفق التشريع الجزائري
Résumé: جمع الآثار البيولوجية (الأنسجة"الجلد والشعر والأظافر"، والسوائل"الدم واللعاب والسائل المنوي"، وما إلى ذلك)، من مكان ارتكاب جريمة الاغتصاب أو مكان آخر، من الضحية أو الجاني المشتبه فيه، والتي تتواجد على الجسم أو على الملابس أو الأشياء التي يلبسونها، وعند تحليلها يمكن أن توفر العديد من الأدلة القيمة في التحقيق الجنائي، فالحمض النووي يحتل مكانة خاصة في أدلة الإثبات، ولتعزيز فعاليته تم إنشاء ملفات أو قواعد لحفظ الحمض النووي(القاعدة الوطنية للبصمات الوراثية)، لأنها سمحت بجمع المواصفات الجينية التي تم الحصول عليها من العينات البيولوجية، والمشرع الجزائري نظم هذه التقنية ضمن القانون16-03.The collection of biological effects (tissues "skin, hair and nails," liquids "blood, saliva, sperm," etc.), from the place of the rape crime commission or elsewhere, from the victim or suspect, and who resides on the body or on the clothes or things they use, and when analyzed can provide many valuable evidence in a criminal investigation, DNA occupies a special place in the evidence , and to improve its efficiency there are created files or databases to safeguard DNA (the national DNA fingerprint database), because they are allowed to collect genetic specifications that were obtained from biological samples, the Algerian legislator organizes this technology within the law 16-03.
