توطين التأمين التكافلي في الجزائر وفق القانون 81-21 Localization Of Takaful Insurance In Algeria According To Law 81-21

Résumé: تهدف هذه الورقة البحثية إلى تبيان المسيرة الاجتهادية لتأسيس شركات التأمين التكافلي منذ أكثر من أربعة عقود متتالية والتطبيقات المعاصرة التي شهدت نموا ملحوظا في الآونة الاخيرة، وقد تم توطين صناعة التأمين التكافلي في الجزائر وتجسيده عمليا على ضوء ما تشهده الترسانة القانونية لبعض دول العالم الاسلامي من تطور ملحوظ في سن القوانين المنظمة لهذه الصناعة المكملة لمنظومة المالية الاسلامية على الرغم من حداثة تجربة العمل المؤسسي للتأمين التكافلي. توصلت الدراسة إلى أن أولى الخطوات العملية للتوطين هي توحيد المرجعية الفقهية للعلاقة بين هيئة المشتركين والصندوق التكافلي، وكذا إرساء الأطر القانونية والتشريعية ومن ثم الالتزام بالجوانب التنظيمية للعمل المؤسسي التكافلي تأسًيا بنصوص الهيئات الشرعية والمعايير الدولية لبعض التجارب الرائدة في تطوير منظومة التأمين التكافلي. This research paper aims to demonstrate the jurisprudential process of establishing Takaful insurance companies for more than four consecutive decades and the contemporary applications that have witnessed remarkable growth in recent times. Notable in the enactment of laws regulating this industry complementary to the Islamic financial system, despite the recent experience of the institutional work of Takaful insurance. The study concluded that the first practical steps for Emiratisation are the unification of the jurisprudential reference to the relationship between the participants’ body and the Takaful Fund, as well as the establishment of legal and legislative frameworks, and then commitment to the regulatory aspects of the Takaful institutional work, following the texts of Sharia bodies and international standards for some pioneering experiences in developing the Takaful insurance system.
