ضمان حق السجين في العمل العقابي في القانون الدولي (guarantee Of The Prisoner To A Punitive Action In International Law)

Résumé: قد جاءت هذه الدراسة التي عنوانها: ضمان حق السجين في العمل العقابي في القانون الدولي للإجابة عن الإشكالية المطروحة: ما هو دور إقرار وتدعيم القانون الدولي لضمان حق السجين خلال فترة التنفيذ العقابي في العمل العقابي، في تجسيد فاعلية إنجاح عملية الإصلاح وإعادة التأهيل الاجتماعي لسجين؟ وتهدف هذه الدراسة إلى توضيح تكييف عمل السجين وأغراضه وكذا بيان شروط العمل العقابي وكيفية تنظيمه القانوني، وضمان حقوق المسجونين في الضمان الاجتماعي في القانون الدولي، وفقا لهاته الأهداف تم تقسيم هذه الدراسة وفقها إلى ثلاثة نقاط رئيسية ممنهجة. بهذا استقرت الدراسة على انه، نظرا لقيمة العمل العقابي في المؤسسات العقابية فقد استقر القانون الدولي على الاعتراف به في عملية إصلاح وتأهيل السجين، ووضعت الأطر المناسبة لتنظيمه في السجون بغية تحقيق مختلف المنافع المعنوية والمادية للسجين والمجتمع. Summary: This study is titled: guarantee the right of a prisoner to a punitive Action in international law to address the problem: what is the role of the establishment and the strengthening of international law to guarantee the right of the prisoner to punitive enforcement? The purpose of this study is to clarify the adaptation of the work of the prisoner and its objectives, as well as a punitive action how to organize legally, the rights of the prisoner to social security in international law, according to objectives, this study was divided into three main systematic points. Thus, the study determined that, given the value of the punitive action in penal institutions, international law was established for recognition in the process of reform and rehabilitation of prisoners. And put in place appropriate frameworks to organize in prisons in order to achieve various benefits moral and material of the prisoner and society
