المسؤولية الجنائية للطبيب على إفشاء السر الطبي The Criminal Responsibility Of The Doctor For Disclosing The Medical Secret

Résumé: الملخص: أن الحفاظ على السر الطبي عن طريق توفر الحماية الجزائية له، يبرره مصلحة المريض كونه يزرع الثقة في نفسية المريض، ويجعله يرتاح للطبيب مسلماً له بدنه وأسراره. لقيام جريمة إفشاء السر الطبي لابد من توفر مجموعة من الأركان صفة المؤتمن على السر، وإفشاء السر، والقصد الجنائي، يرد على الجريمة بعض الاستثناءات، يجب فيها على الطبيب أن يبوح بالأسرار الطبية دون أن تقوم مسؤوليته الجزائية. Abstract: The preservation of the medical secret through the provision of criminal protection, justifies the interest of the patient as it cultivates confidence in the psyche of the patient, and makes him comfortable to the doctor, A Muslim has his body and secrets. The crime of disclosure of medical confidentiality is based on three pillars of the offender's character, the disclosure of the secret, and the criminal intent.There are some exceptions in which the doctor must disclose medical secrets without his criminal responsibility.
