نظام المحاكمة الالكترونية وفقا لأحكام قانون عصرنة العدالة 15-03

Résumé: اعتمد المشرع الجزائري نظام المحاكمة عن بعد في قطاع العدالة بموجب قانون عصرنة العدالة 15-03. ولكن لم يتم تفعيل هذا النظام، إلى غاية سنة 2020، مع تفشي فيروس كورونا (covid19) أين اضطر المشرع إلى تعديل قانون الإجراءات الجزائية بموجب لأمر 20-04. حيث أجاز للجهات القضائية إمكانية اللجوء لاستعمال تقنية المحادثة المرئية عن بعد للحفاظ على الأمن أو الصحة العمومية كما هو الحال خلال جائحة كورونا أو أثناء الكوارث الطبيعية، وحتى احتراما لمبدأ الآجال المعقولة في التقاضي . بل وأتاح للسلطة القضائية اللجوء إلى استخدام تقنية المحادثة المرئية عن بعد خلال مرحلة التحقيق القضائي، وأثناء المحاكمة، من دون اشتراط موافقة الخصوم والنيابة العامة على استخدام هذه التقنية. الكلمات المفتاحية: التقاضي الالكتروني، سرية الإرسال، التحقيق القضائي عن بعد، رقمنة الإجراءات القضائية. Abstract: The Algerian legislator adopted the system of remote trials in the justice sector within the framework of the law of modernization of justice 15-03. However, this system was only activated in 2020, with the epidemic of the Corona virus (covid19), where the legislator was forced to modify the code of criminal procedure by virtue of ordinance 20-04. When it authorized the judicial authorities to use videoconferencing technology to maintain public safety or health, as during the Corona pandemic or during natural disasters, and even out of respect for the principle of reasonable delays in litigation . On the contrary, it allowed the judiciary to resort to the remote use of videoconferencing technology during the investigation phase and during the trial, without requiring the consent of the litigants and the prosecution to use this technology. key words: Electronic litigation, confidentiality of transmissions, remote judicial investigation, digitization of legal proceedings.
