المحاكمة المرئية عن بعد بين تفعيل وتقييد ضمانات المتهم في الجزائر

Résumé: تدخل عملية رقمنة قطاع العدالة في إطار التكيف مع تحولات العولمة ومسايرة التطورات التكنولوجية ، ولقد انعكس هذا التطور ايجابيا على العمل القضائي خصوصا في مرحلتي التحقيق والمحاكمة من خلال استعمال تقنية المحادثات المرئية عن بعد. ولقد كرس المشرع الجزائري استخدامها بموجب صدور القانون15/03 المتعلق بعصرنة العدالة .والملاحظ أن القضاء الجزائري لم يستعمل تقنية محادثة المرئية عن بعد بشكل كبير بعد صدور القانون 15/03 ، غير أن تداعيات انتشار جائحة كورونا جعلت استخدامها ضرورة حتمية مما دفع المشرع الجزائري إلى تحيينها سنة 2020 بموجب الأمر 20/04 المعدل والمتمم لقانون الإجراءات الجزائية . The process of digitizing the justice sector is part of the process of adapting to the transformations of globalization and keeping pace with technological developments. This development has been reflected positively in judicial work, particularly in the investigation and prosecution phases, through the use of visual teleconference technology. The Algerian legislature has enshrined its use under Law No. 15/03 on the Modernization of Justice. The Algerian judiciary has not used the technique of telemedicine significantly after the promulgation of Law No. 15/03. However, the repercussions of the coronavirus pandemic have made its use imperative.
