الحماية القانونية للدعاية الانتخابية من جرائم التمييز وخطاب الكراهية Legal Protection For Electoral Campaigning Against Discrimination And Hate Speech

Résumé: إن الحملة الانتخابية تعد مرحلة مهمة من العملية الانتخابية وقد عهد إلى الإدارة العمومية تنظيم و تأطير هذه الأخيرة ، لضمان الشفافية و النزاهة وعدم المساس بالمبادئ الأساسية للعملية الانتخابية ، إلا أن الإدارة (ممثلة في موظفيها) قد تقوم ببعض الاعمال المشبوهة كتفضيل مرشح على آخر بناءا على أسس عرقية أو جغرافية أو دينية أو إثنية ، مما يترتب عليه مساس بالحقوق و الضمانات المكفولة قانونا للمرشحين من جهة ، كما أن المرشحين و في خضم سعيهم الى الوصول الى مقاليد السلطة قد يقومون باستغلال الفوارق الدينية و العرقية و الثقافية و كذا الجغرافية في العملية الانتخابية من خلال الوسائل التقليدية للحملة الانتخابية كالمسيرات و المؤتمرات و الخطابات ، مما قد ينجر عنه جرائم تمييز و خطاب الكراهية . الكلمات المفتاحية: - الحملة الانتخابية – جرائم التمييز -خطاب الكراهية . Abstract: The electoral campaign is an important stage of the electoral process, and the public administration has been entrusted with organizing and supervising the latter, to ensure transparency and integrity and not to prejudice the basic principles of the electoral process. Racial, geographical, religious or ethnic grounds, which entails prejudice to the rights and guarantees legally guaranteed to the candidates on the one hand, and the candidates, in the midst of their quest to reach the reins of power, may exploit religious, ethnic, cultural and geographical differences in the electoral process from Through the traditional means of the electoral campaign such as marches, conferences and speeches, which may result in crimes of discrimination and hate speech.
