أحكام الأسرة واعتبار المآل (دراسة مقاصدية لبعض المسائل أنموذجا).

Résumé: الملخص: تهدف هذه الدراسة إلى إبراز أهمية القاعدة المقاصدية: "قاعدة اعتبار المآل"؛ حيث تبين أنها أصل من أصول الاجتهاد الفقهي، له أدلته وحجيته، وله فروع تندرج منه وله آثاره. ثم تحاول أن تنقله من النظرية إلى التطبيق في أهم جانب من جوانب الفقه الإسلامي والذي أولاه التشريع الإسلامي عناية خاصة ألا وهو أحكام الأسرة، فاختارت بعض المسائل كالولاية في الزواج ونكاح التحليل، ومنها ما يحدث غالبا عند الأقليات المسلمة في بلاد الغرب كالزواج بنية الطلاق والزواج بالكتابيات. وحاولت الدراسة أن تنزل الأحكام على هذه المسائل وهي تنظر إلى ما ستؤول إليه الأمور في المستقبل من استقرار في الأسرة، ودوام سعادة وحسن معاشرة؛ والتي هي مقاصد شرعية أساسية للزواج الإسلامي ليخرج منه نسل صالح يعبد ربَّه، ويعِّز أمَّته بعد هذا الذل والهوان الذي أصابها بين الأمم، وما ينخر في جسمها من الداخل من تشرذم شبابها، وتفكك أسرها، وانتشار الظواهر السلبية الخطيرة في مجتمعاتها.
