مصير اتفاقيات حقوق الانسان في النظام القانوني الجزائري The Fate Of Human Rights Conventions In The Algerian Legal System

Résumé: تهدف هذه الورقة البحثية لتسليط الضوء على مسألة ادماج اتفاقيات حقوق الانسان في النظام القانوني الجزائري و النتائج المترتبة عن ذلك لاسيما تطبيق القاضي لأحكامها في النزاعات المعروضة عليه ، علما أن الجزائر قد كرست منذ دستور 1989 مبدأ سمو المعاهدة الدولية على القانون و لم يتردد القاضي الجزائري في تطبيق المبدأ فيما يخص اتفاقيات حقوق الانسان التي تعد كقاعدة عامة من الاتفاقيات القابلة للتطبيق المباشر و تمكن الأفراد من التذرع بها امام المحاكم الوطنية ، و مع التعديل الدستوري الناتج عن استفتاء أول نوفمبر 2020 و مختلف الأحكام المستحدثة ستعرف التطبيقات القضائية بما فيها تلك المتعلقة بالمحكمة الدستورية التي ستحل محل المجلس الدستوري قبل نهاية السنة بعدا جديدا This research paper aims to shed light on the issue of integrating human rights conventions into the Algerian legal system and the consequences thereof, especially the judge’s application of its provisions in the disputes before him, The Algerian judge did not hesitate to apply the principle with regard to human rights agreements, which are considered as a general rule of agreements directly applicable and enable individuals to invoke them before national courts. With the constitutional amendment resulting from the referendum of November 1, 2020, and the various new provisions, judicial applications, including those related to the Constitutional Court, which will replace the Constitutional Council before the end of the year, will have a new dimension.
