Résumé: ساهمت المحاكم الجنائية الدولية في تطبيقاتها القضائية بصدد جريمة الإبادة الجماعية بقسط وافر من الكشف القانوني الذي عرفته، فكان أن حددت المكونات المختلفة لها بأن فككت مفهومها و صنفته و أضافت إليه الأركان و الشروط. و بتتبع السوابق القضائية محل الدراسة في هذا المقال نجد أن مستويات تأثير المحاكم الجنائية الدولية على تنظير جريمة الإبادة الجماعية تعددت بين وضع تعريف واضح للجماعات المحمية بمقتضى نصوص مكافحة و عقاب جريمة الإبادة الجماعية، و صياغة معايير تحدد بها الجماعات ذات الخصوصية الإثنية أو الدينية أو القومية، و تطوير عناصر الركن المعنوي للجريمة بأن وضعت حدود نية الإبادة و كيفيات إثبات وجودها.

we find that the impact levels of the International Criminal Tribunals on the Crime of genocide varied between a clear definition to the groups protected under the legal provisions to control and punishment of the Crime of Genocide

and the formulation of set of standards to determine the ethnic

religious or national groups

and the development of the mental element in the crime that put limits to the genocide intention and modes to proof its existence.
