التنمية و التسيير المستدام للثروة الغابية و حمايتها في ظل القانون الجديد 21/23

Résumé: نظرا للحرائق و الإتلاف و التخريب الذي مس الغابات في السنوات الأخيرة خاصة سنة 2021، وما خلفه ذلك من خسائر بشرية و مادية و أخطار و أضرار بيئية و بشرية، كان لزاما على المشرع الجزائري التدخل الفوري من أجل وقف هذه الظواهر السلبية و القضاء عليها وتعزيز طرق و أساليب الحماية القانونية للثروة الغابية، نظرا لما لها من أهمية بالغة في تحقيق التوازن البيئي و التنوع البيولوجي ناهيك عن الدور الإقتصادي و الإجتماعي، وقد تجسد ذلك بصدور القانون الجديد للغابات رقم 23/21 المؤرخ في 23 ديسمبر 2023 و الذي تضمن آليات حماية لم يعرفها القانون القديم الملغى 84/12، و التي من شأنها المساهمة الفعالة في توفير الحماية اللازمة و المحافظة على الثروة الغابية بشكل يلبي إحتياجات الأجيال الحالية و الأجيال المستقبلية على حد سواء. In view of the fires, damage, and sabotage that affected forests in recent years, especially in the year 2021, and the human and material losses that this resulted in, as well as environmental and human dangers and damages, it was necessary for the Algerian legislator to intervene immediately in order to stop these negative phenomena, eliminate them, and strengthen methods And methods of legal protection of forest wealth, given their great importance in achieving environmental balance and biological diversity, not to mention their economic and social role. This was embodied in the issuance of the new Forest Law No. 23/21 dated December 23, 2023, which included previously unknown protection mechanisms. The repealed old law 84/12, which would effectively contribute to providing the necessary protection and preserving forest wealth in a way that meets the needs of current and future generations alike.
