قانون الدولة المضيفة كأساس لتسوية منازعات عقود الاستثمار الأجنبي

Résumé: يعد التحكيم التجاري الدولي آلية لفض المنازعات ذات الصبغة الدولية، يتجلى إما في نطاق تحكيم حر أو مؤسساتي، هذا الأخير يتجسد في إطاره المركز الدولي لتسوية منازعات الاستثمار الأجنبي بين الدول و رعايا الدول الأخرى؛ الذي وجد خصيصـــا لتسوية المنــــــازعات القائمة بيــــن الدولــــــة و المستثمر الأجنبي بمناسبة إبرام و تنفيذ العقود الدولية. إذا كان المركز الدولي قد حدد المبدأ في تسوية المنازعات باللجوء إلى إعمال قانون الأطراف، فإنه في حالة غيابه قد يتم إعمال قانون الدولة المضيفة، ذلك ما يثير عدة إشكالات تتمثل خاصة في كيفية الموازنة بين مقتضيات السيادة الوطنية من جهة و ضرورة حماية الاستثمارات الأجنبية من جهة أخرى. : International commercial arbitration is a mechanism for settling disputes of an international nature, which is manifested either in the framework of free or institutional arbitration, the latter embodied in its framework, the International Center for the Settlement of Foreign Investment Disputes between States and Nationals of Other States; Which was found specifically for settling disputes between the state and the foreign investor on the occasion of the conclusion and implementation of international contracts. If the International Center has determined the principle of settling disputes by resorting to the implementation of the law of the parties, in the absence of it, the law of the host country may be implemented, which raises several problems, especially how to balance the requirements of national sovereignty on the one hand and the need to protect foreign investments on the one hand Other.
