حماية التراث الثقافي في القانون الدولي وفي الشريعة الإسلامية.

Résumé: الملخص: للتراث الثقافي أهمية كبيرة، فهو رصيد الدول والشعوب الدائم من التجارب والخبرات وهو ما يعطي الإنسان القدرة على مواجهة الحاضر، وتصور المستقبل، وصناعة الحضارة. ولقد شهد التراث الثقافي خلال تطوراً كبيراً في مفهومه، وفي ادراك اهميته. لقد تعرض التراث الثقافي للعديد من الأخطار والتهديدات جعلت المجتمع الدولي يسارع لبذل جهود كبيرة، خاصة عقد الاتفاقيات الدولية لإنشاء القواعد القانونية لحمايته. إلا أنه لا يزال يتعرض للتدمير والتخريب وهو ما دل على حاجة قواعد القانون الدولي-رغم الجهود المبذولة- إلى أنظمة أخرى لها اسهاماتها و مبادؤها، وقواعدها التي تضاف الى الجهود الدولية في مجال حماية التراث الثقافي، وهو ما تضمنته أحكام الشريعة الإسلامية؛ التي أسهمت، وحوت من المبادئ، والقواعد التي تحمي التراث الثقافي ما يفوق أحياناً ما نطوى عليه القانون الدولي. Abstract: Cultural heritage is of great importance, as it is the permanent balance of states and peoples of experiences and expertise, which gives people the ability to face the present, envision the future, and create civilization. Cultural heritage has witnessed a great development in its concept, and in realizing its importance. Cultural heritage has been exposed to many dangers and threats that made the international community hasten to make great efforts, especially concluding international agreements to establish the legal rules to protect it. However, it is still subjected to destruction and sabotage, which indicates the need for the rules of international law - despite the efforts made - for other systems that have their contributions and principles, and their rules that are added to international efforts in the field of protecting cultural heritage, which is included in the provisions of Islamic law Which contributed, and contained, of the principles and rules that protect cultural heritage, which sometimes exceeds what is contained in international law. .
