الضمانات القانونية للطفل الجانح أثناء مراحل الدعوى الجزائية في ظل القانون رقم:15-12 المتعلق بحماية الطفل.

Résumé: ملخص : تعتبر الإجراءات الجزائية التي تتخذ في مواجهة الطفل الجانح ذات طبيعة خاصة نظرا لخصوصية هذه الشريحة، وبالرجوع للتشريع الجزائري نجده قد أفرد لطائفة الأطفال بميلاد تشريع جديد من خلال سنه للقانون رقم: 15-12 المتعلق بحماية الطفـل. وعلى ضوء ذلك سنتعرض لمختلف الضمانات القانونية والأساليب الحديثة التي خصها المشرع الجزائري لمعاملة هذه الفئة،التي تتضمن جملة من الحقوق والإجراءات الخاصة التي يقع على عاتق الجهات الأمنية و القضائية والاجتماعية التقيد بها واحترامها وبالخصوص أثناء التعامل مع الطفل الجانح خلال جميع مراحل الدعوى الجزائية، مراعيا من وراء ذلك المصلحة الفضلى للطفل الجانح في حمايته وإصلاحه. Abstract: The penal measures that are taken against a delinquent child are of a special nature due to the peculiarity of this segment, and with reference to the Algerian legislation, we find that the child community has been singled out for the birth of a new legislation through the Law No. 15-12 related to child protection. In light of this, we will review the various legal guarantees and modern methods that the Algerian legislator has assigned for the treatment of this group, which includes a set of rights and special procedures that the security, judicial and social authorities have to abide by and respect, especially while dealing with the delinquent child during all stages of the criminal case, taking into account the best interest of the delinquent child in protecting and repairing him
