الزواج المختلط الصوري وتجريمه في القانون الجزائري.

Résumé: ملخص: تعالج هذه الدراسة مسألة الزواج المختلط الصوري وتجريمه في القانون الجزائري، لهذا فإن تبين هذا النوع من الزيجات هو ذلك الاتفاق المبرم بين الرجل والمرأة على أن يظهرا للغير في صورة زوجين ولكن في الحقيقة لا يريدان الارتباط ولا تحقيق أي غاية من غايات الزواج، ونظرا لخطورة هذا الزواج على المجتمع الجزائري جرم المشرع كل زواج بهذا النوع من خلال أحكام المادة 48 من القانون08 - 11 المتعلق بشروط دخول الأجانب إلى الجزائر وإقامتهم بها وتنقلهم فيها، سواء ارتكب من طرف فرد وطني أو أجنبي بصفة فردية أو جماعية قد تصل العقوبة فيها إلى 10 سنوات حبسا في بعض الحالات وغرامات مالية قد تصل إلى 2.000.000 دج، إلى جانب عقوبات أخرى تكميلية. Abstract: It focuses on the issue of mixed marriages and criminalizing them in Algerian law. This research shows that this type of marriage is the agreement between men and women to show others in the form of a couple, but in fact they do not want to associate and do not achieve any of the goals of marriage and given the seriousness of this marriage to society, especially the State. Article 48 of the 08-11 Code on Conditions of Entry, Residence and Movement of Aliens in Algeria, whether committed by a national or foreign individual individually or collectively, may be punishable by up to 10 years' imprisonment in some cases and fines of up to 2000.000 DZD and other supplementary penalties.
