Résumé: مما لاشك فیه أن موضوع الجزاءات الإداريةالعامة تعتبـر مـن أهـم المواضـیع الأساسـیة والهامــة وكــذلك الحدیثــة فــي مجــال العلــوم القانونیــة والإداريــة، حیــث خــول المشــرع لــلإدارة حــق توقیع الجزاءات الإداريـة مـع تقیـدها والضـمانات القانونیـة لمشـروعیتها، ممـا مـنح لهـا امتیـازات الســــلطة العامــــة فــــي اتخــــاذ الجــــزاء المناســــب علــــى كــــل مــــن النصــــوص القانونیــــة أو اللــــوائح والتنظیمــات المعمــول بهــا والتــي لا تســتوجب اللجــوء للقضــاء للعقــاب علیهــا، إلا أن الجــزاءات الإداريـــة العامـــة تعتبـــر فكـــرة جدیـــدة وهـــذا ماجعلهـــا تتمتـــع بعـــدةخصـــائص تمیزهـــا عـــن غیرهـــا والمتمثلـــة فـــي كونهـــا جـــزاء توقعـــه الســـلطة الإداريـــة وذو طبیعـــة ردعیـــة وتتصـــف بالعمومیـــة ، حیـــث تنقســـم الجـــزاءات الإداريـــة العامـــة إلـــى أقســـام وأنـــواع متعـــددة، فقســـمناها إلـــى الجـــزاءات الإداريــــة المالیـــــة (الغرامـــــة الإداريـــــة والمصـــــادرة) والجـــــزاءات الإداريـــــة غیـــــر المالیـــــة (ســـــحب الترخیص و الغلق الإداري)، إضافة إلى إقرار المشرع لمجموعة من الضمانات سواء مـا كـان منهـــا متعلقـــا والضـــمانات الشـــكلیة والإجرائیـــة أو الموضـــوعیة التـــي أشـــرنا إلیهـــا والتـــي تهـــدف جمیعها إلى ضمان مشروعیة الجزاءات الإدارية العامة.There is no doubt that the subject of public administrative penalties is considered one of the most basic, important and modern topics in the field of legal and administrative sciences, as the legislator has granted the administration the right Imposing administrative sanctions while adhering to them and legal guarantees of their legality, which granted them privileges.
