عن ملاءمة الجزاءات الإدارية في حماية البيئة

Résumé: ملخص: يعتبر حماية البيئة من الموضوع التي حظيت باهتمام كبير من قبل التشريعات من خلال تخصيصها لأحكام صارمة في المجال تضمنت بالخصوص آليات الحماية من أبرزها توقيع الجزاءات بمختلف أنواعها من بينها الجزاءات الإدارية. والتي يقصد بها تلك الجزاءات التي تصدرها سلطات إدارية بتفويض من المشرع لتوقيعها على فرد طبيعي أو شخص معنوي في حالة ارتكابهم للجرائم الماسة بالبيئة، فسلطة الإدارة في فرض الجزاء الإداري مرهونة أساسا بوجود نص قانوني مسبق سواء كان مصدره تشريعي أو تنظيمي. يعد المشرع الجزائري من المشرعين الذين عملوا على سن ترسانة من النصوص القانونية تضمن مجموعة من التدابير والآليات بهدف حماية البيئة والصحة العامة من المخالفات البيئية التي يسببها الأشخاص الطبيعيين أو المعنويين (المنشآت)، ومن هذه الآليات نجد الجزاءات الإدارية، الكلمات المفتاحية: البيئة، الجزاءات الإدارية، المشرع الجزائري، الحماية. Abstract : On the suitability of administrative sanctions in the protection of the environment : The protection of the environment is a subject that has been the subject of great attention from the legislation through the attribution of strict provisions in the field, including in particular protection mechanisms, the most important of which is the imposition of penalties of various kinds, including administrative penalties. That is to say the sanctions issued by the administrative authorities authorized by the legislator to be imposed on a natural person or a legal person in the event of an offense against the environment. The power of the administration to impose an administrative sanction essentially depends on the existence of a prior legal text, whether its source is legislative or organizational. The Algerian legislator is one of the legislators who have worked for the promulgation of an arsenal of legal texts comprising a set of measures and mechanisms to protect the environment and public health from environmental damage caused by natural persons or morals (establishments), Among these mechanisms are administrative sanctions.
