العلاقة بين مبدأي السيادة الإقليمية وحق تقرير المصير في ضوء القانون الدولي

Résumé: الملخص: يعتبر كلا من مبدأي السيادة الإقليمية للدول وحق تقرير المصير من المبادئ الأساسية في القانون الدولي والمكرسان بموجب ميثاق الأمم المتحدة، الذي جعلهما في مستوى واحد من الأهمية؛ إذ نص في إحدى مبادئه على حظر استخدام القوة أو التهديد باستخدامها ضد السلامة الإقليمية للدولة، أو استقلالها السياسي، أو على أي وجه آخر لا يتفق ومقاصد الأمم المتحدة والتي من بينها حق الشعوب في تقرير المصير. والملاحظ أن العلاقة بين المبدأين ايجابية وتكاملية وهذا على الأقل نظريا، لكن كشفت الممارسة الدولية في الآونة الأخيرة عن تعارض نشأ عند إعمال تقرير المصير مع السلامة الإقليمية للدولة، ومن ثم يدور موضوع دراستنا حول المنطلقات القانونية وطبيعة العلاقة بين إعمال مبدأي تقرير المصير والسيادة الإقليمية للدول . Abstract: The principles of the territorial sovereignty of States and the right to self-determination are fundamental principles of international law are among the essential principles in the international law and dedicated pursuant to covenant of United Nations, that made them in the same level of importance. In one of these principles it forbidden the use the forces or the threat against the regional safety for the state, or their political independence, or on any face does not agree with the intentions of United Nations such as self-determination be true. So we observe that the relationship between these two principles is positive and inerrability, But the international practice now a days discovered a conflict operation of self-determination, there for our subject of study is around the legal starting point and nature of the relationship between operation principles of self-determination revolves our and the regional rule for the states and the difference between them
